What is Unlawful Termination?

With the current high rate of unemployment around the globe, termination of your contract can be devastating and more so when it’s an unlawful termination. So what is unlawful termination and what rights do employees have? What are the consequences an employer might face for an unlawful termination of your contract? Unlawful termination of your job means that you have been fired without a just or legal cause and in most cases it comes as a shock to the person affected. There are various reasons that an employer can’t terminate your employment, and if he or she does uses any of these reasons, then it becomes an unlawful termination. These reasons include, but are not limited to, the following such as: firing an employee for a temporary absent from work because of an injury or illness, being fired for participating in trade union activities when it’s outside working hours, being fired based on your race, sex, color or any other form of discrimination, etc. When an employee has been laid off, terminated or demoted for any reason that is illegal in the eyes of the state’s law, there can be serious consequences.

Whenever an employee gets fired, he or she should examine whether there was a valid and legal reason for being fired. If they feel that they were wrongfully dismissed from their work, he or she should seek legal action immediately. In some states, an unlawful termination application for a case is supposed to be made within twenty-one business days after the dismissal.

There are some consequences the employer might suffer when an employee seeks legal action for a wrongful termination. Once done within the time limit, some consequences include money compensation that the company may be forced to pay. In cases where you are yet to get released from employment, the employer may be compelled to reinstate you or even have a handsome sendoff package for you.
