Life is difficult enough without feeling like you are being treated differently. Regardless of what your disability is, you don’t deserve to be discriminated against. We can help to protect your rights. Our California Disability Discrimination Lawyer team is ready to fight for you, serving all of California, including Los Angeles. Examples of Disability Discrimination

It’s important to understand that disability discrimination can take many forms. Beginning in the 1980s, the federal Americans with Disabilities Act (ADA) (enforced by the Equal Employment Opportunity Commission (EEOC)), and California’s Fair Employment and Housing Act (FEHA) (enforced by the Civil Rights Department (CRD)), among other federal and state laws, were enacted to prohibit employment discrimination and harassment based on a person's disability or perceived disability. This includes discrimination or less favorable treatment if the employee is believed to have a history of disability (such as cancer, for instance, that is controlled or in remission), or a disability that is minor and will last only up to six months. With assistance from accomplished employment lawyers who know and understand the anti-discrimination laws, workers with disabilities are afforded an enhanced level of protection against adverse employment actions and discrimination resulting from the workers’ disabilities.

There are many examples regarding the manner in which employees with disabilities are discriminated against in the workplace. Here are just a few:
  • Basing hiring, firing, or promotion decisions on an employee’s disability
  • Unfair or unequal job assignments
  • Unequal pay or benefits
  • Not providing reasonable accommodations, or other ADA or FEHA violations
At UELG, our experienced Disability Discrimination Lawyer team and other UELG employment lawyers who handle all types of workplace discrimination matters have a firm grasp of these laws, and fight for justice on behalf of workers against illegal and unfair treatment due to actual or perceived disability.

Retaliation

People's greatest hesitation to share their experiences of discrimination is a fear of reprisals. You are fully entitled to make a claim if you have experienced disability discrimination. It is utterly unacceptable for you to be dismissed or subjected to punishment for reporting discrimination to HR or your supervisor. To reduce the chance of retaliation against you, contact UELG. Employees need to understand that they are not powerless to seek justice. You have rights. We'll defend those legal rights at United Employees Law Group.

Have your promotion opportunities been disregarded? Do you believe your impairment played a role in your failure to land a job? Are your coworkers acting differently toward you?
We pledge to listen to you, and carefully examine the evidence presented to determine if disability discrimination may have occurred or is occurring. The fact that you are a victim of prejudice is not always obvious so we need to discuss the facts with you in detail.

You constantly cope with stress in your life. We want to relieve some of your burden and get you the support you require. No one anticipates dealing with an employment law case until it actually happens. Disability discrimination and proving it can be a complex matter, but it is possible. You may not have the time or knowledge to pursue your own disability claim. For this reason, you may wish to speak with a California disability discrimination attorney or handicap discrimination attorney who can assist you.
It might be challenging to know what to do after being the target of discrimination. The employee handbook may be available for reference. Take any necessary action and try to adhere to those steps if provided. If you were fired or refused employment due to discrimination, obviously this isn’t an option. The best course of action in such circumstances is to contact a California disability discrimination attorney directly.
No. An employer is not permitted to inquire about the kind or severity of an existing disability or to ask if a prospective employee has a disability. However, an employer is allowed to inquire with applicants about their ability to carry out the tasks and responsibilities of the position without making reasonable accommodations.
